Kogeneracija u svetlu odredaba o državnoj pomoći EU

Abstract

Kombinovana proizvodnja električne i toplotne energije (kogeneracija) postaje sve značajniji činilac u ukupnoj energetskoj politici Evropske unije. Zbog toga, države članice žele da pospeše razvoj ovih tehnologija i investicije u otvaranje novih postrojenja. Problem je u tome što kompanije, po pravilu, nemaju dovoljno vlastitih sredstava za investicije u postrojenja za kogeneraciju. Državna pomoć predstavlja instrument koji olakšava investicije u ovoj oblasti, ali može doći u sukob sa članom 107(1) Ugovora o funkcionisanju Evropske unije. Zbog toga, Evropska komisija je propisala uslove pod kojima će pomoć za investicije u postrojenja za kogeneraciju biti dopuštena. Cilj ovog rada je da ukaže na osnovne crte politike državne pomoći EU u ovoj oblasti, što će predstavljati orijentir Komisiji za kontrolu državne pomoći Republike Srbije.

Combined production of heat and power (cogeneration) is becoming an increasingly important factor in overall EU energy policy. Therefore, Member States want to boost the development of these technologies and investments in opening new facilities. The problem is that companies usually do not have sufficient internal funds for investments in cogeneration plants. State aid is an instrument that allows investment in this area, but may come in conflict with Article 107 (1) of the Treaty on the Functioning of the European Union. Therefore, the Commission has prescribed the conditions under which aid for investments in cogeneration facilities will be permitted. The aim of this paper is to present the main features of EU state aid policy in this area, which will be a landmark for Commission for state aid control of Republic of Serbia.
