Policy of raising the capacity of local self-governments for management of emergencies

AB  - Local self-governments (LSGs) cannot effectively manage emergencies. To overcome this problem, it is necessary to find action policies 
that would facilitate the increase of capacities of LSGs in such situations. The starting point for defining the policy was collecting data on the current 
abilities and capacities of LSGs in AP Vojvodina. The research covered 40% of the total number of LSGs and more than 64% of the population in the 
AP of Vojvodina. A combined open-ended survey questionnaire was constructed for data collection. The data was collected in field conditions 
through online procedures, direct sending of written surveys, and direct discussion of project implementation leaders. The statistical analysis of data 
identified that the legal aspect of LSGs and emergencies was not harmonized with other institutional documents at the level of LSGs. Most LSGs had
serious difficulties in managing emergencies, especially civil protection. The platform is envisaged to facilitate raising the prevention capacity of LSGs by integrating all relevant information to provide early warnings and indications for implementing corresponding organizational, technical, and 
economic measures to deal with emergencies.

Local self-government in a crisis caused by the Covid-19 pandemic: the case of Serbia

AB  - This research examined whether there is an elaborate system of protocols, protection, and prevention in place at the local self-government level in the event of a crisis caused by an epidemic or pandemic. The core idea of this paper was to evaluate the protocol's effectiveness at the local self-government. Analysis was conducted using responses of 16 local self-government authorities. During a crisis caused by an epidemic/a pandemic of infectious illnesses, surveys were done as a cross-section documenting and detecting the current state of local self-government functioning. Methods used in the study are defining the objectives of the research, conceptualization, analysis of legal regulations, economic analysis, and decomposition of the problem. Key results and arguments of this paper expanded existing research thus there are only certain empirical data from areas that have been affected by the infectious disease caused by the epidemic/pandemic. Data was collected, processed, and systematized to serve in model formulation. As a brief conclusion, this study suggested protocol effectiveness at the local self-government level representing the idea that emergency and crisis management should be organized to preserve the health and livelihood of the population in the area affected by the pandemic of infectious diseases and thus enable the functioning of economic activities and society as a whole.

Conceptual approach to organizing local self-government in emergency situations

AB  - Emergency situations arise as a result of various events. The work of local selfgovernments in emergency situations implies efficient action on mitigating the
consequences of emergency situations. The way of effective action of local
self-government in such a situation is a challenge for effective counteraction
to the emergency situation.
The paper describes one of the possible ways of local self - government to act
in emergency situations, to successfully mitigate the consequences and protect
and rescue the population in such a situation. The paper uses the method of
content analysis, as well as the legal-logical methods of induction and
deduction.

Chinese social credit system: New challenges for the right to privacy?

AB  - The Social Credit system (SCS) in China is being applied in an increasing number of areas of everyday life. This system is built around rewarding and punishing specific forms of social behavior. The question arises whether this system is a new challenge to the right to privacy. The study, which is supported by literature, sheds light on how novel this thought is. This paper uses the comparative method, normative method, and legal-logical methods of induction and deduction. According to the research, the SCS in basic is a state project. The key distinctions between the SCS and similar systems in Western countries include the impact on individuals, state dependency, punitive policy, the breadth of consequences, and cultural differences. In addition, one of the tools of the SCS in China is shame‘, which is focused on maintaining harmonious relations within a society. In the West, the focus is more on the citizens‘ rights.

AB  - Modern internet users face various challenges and opportunities for
identity verification. The motive of this paper is to acquaint users with identification
mechanisms in order to prevent identity theft and data protection. This research is
based on user identification that uses multi-factor authentication (MFA). The
research determined the current familiarity of users with the mechanisms of MFA, as
well as their general opinions about this technology. The research used several of the
most visited sites from our region, which have this type of identity verification. The
comparative method, normative method and methods of induction and deduction were
used in the research.

AB  - U Evropskoj uniji ne postoji "krovni" propis kojim se uređuje čuvanje podataka u klaudima, već je to uređeno većim brojem pravnih akata. Jedan od glavnih izvora prava u vezi sa čuvanjem podataka u klaudu predstavlja Uredba Evropske unije o zaštiti pojedinca u vezi sa obradom ličnih podataka i o slobodnom kretanju takvih podataka, kao i stavljanju van snage Direktive 95/46/EZ. Uredba se primenjuje i na klaud provajdere sa sedištem izvan Unije. Istraživanje je pokazalo da će klaud provajderi biti odgovorni za svoje postupke u vezi sa obradom podataka o ličnosti. Za nepoštovanje odredaba Uredbe predviđene su visoke novčane kazne do čak 20 miliona evra ili 4% godišnjeg prometa. Poseban problem za klaud provajdere predstavljaće sprovođenje prava na zaborav, s obzirom da su lokacije podataka često nepoznate, kao i veliku pokretljivost podataka u klaud okruženju. Klaud provajderi će imati obavezu da procenjuju da li je zahtev za brisanje podataka opravdan, što predstavlja pravno pitanje, i iziskivaće značajne troškove za klaud provajdere. Istraživanjem je utvrđeno da je potrebno detaljnije urediti oblast prenošenja podataka između različitih klaud platformi, a pokazalo se da će manji klaud provajderi imati teškoće u vezi sa ugovorom sa pod-obrađivačima, s obzirom na stroge zahteve Uredbe. Najzad, utvrđeno je da Uredbom nisu detaljnije uređena pitanja zaštite podataka pseudonimizacijom ili šifrovanjem. U radu su korišćeni normativni metod i pravno-logički metodi indukcije i dedukcije.
AB  - In the European Union there is no "roof" rule governing the storage of data in the cloud, but it is governed by a large number of legal acts. One of the main sources of law in connection with storing data in the cloud represents a Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. The Regulation also applies to cloud providers based outside the Union. Research has shown that cloud providers will be responsible for their actions in relation to the processing of personal data. For violating the provisions, the Regulation provides for high fines up to 20 million Euro or 4% of annual turnover. A particular problem for cloud providers is implementation of the right to forgotten, considering that the location data is often unknown, and great mobility data in a cloud environment. Cloud providers will be required to assess whether the request for forgotten is justified, which is a legal issue, and will require significant costs for cloud providers. The research has found that it is necessary to further regulate transfer data between different cloud platforms, and that smaller cloud providers will have difficulties related to the contract with sub-processors, due to the strict requirements of the Regulation. Finally, it was found that the Regulation did not regulate data protection issues, such as pseudonymisation or encryption.The research used normative methods and legal and logical methods of induction and deduction.

AB  - Jedan od osnovnih makroekonomskih fenomena - indikatora svake privrede jeste stanje na tržištu rada i pitanje zaposlenosti, jer ono sa sobom nosi pitanje migracije, pa i problematiku opstanka malih nacija u svom ekstremnom smislu. Iako je Republika Srbija kandidat za članstvo u Evropskoj uniji već više od šest godina, pred njom je veliki broj zahteva i ciljeva koje je neophodno ostvariti za dobijanje statusa člana Unije. Svakako da je jedan od njih I makroekonomska stabilnost, koja je teško ostvariva uz veliku nezaposlenost radno sposobnog stanovništva (15,9%, 2016), i 2,20 puta veću stopu nezaposlenosti mladih (45%, 2016). U radu će pored problema nezaposlenosti mladih u Srbiji i fenomena odliva mozgova, biti dat i predlog mera za rešenje problema nezaposlenosti. Takođe, biće predstavljene i uporedne analize (ne)zaposlenosti u Srbiji od početka krize, kao i projekcije kretanja radne snage do 2020. godine. Autori će ukazati i na Strategiju 2020, u segmentu koji se odnosi na tržište rada, kao i očekivane, odnosno ciljne stope zaposlenosti i predloge njihovog dostizanja, uz naglasak da je donošenje Nacionalnog okvira kvalifikacija neophodnost u cilju sinhronizacije tržišta rada Republike Srbije, kako internog tako i usklađivanje sa evropskim okvirom kvalifikacija.
AB  - One of the basic macroeconomic phenomena - indicators of any economy - is the labor market situation and the issue of employment, since they imply questions of national importance - migration, as well as the problem of survival of small nations in the extreme. Although the Republic of Serbia is a candidate for membership in the European Union for more than five years, it has a large number of demands and goals that have to be achieved in order to become a member of the Union. Certainly one of them is macroeconomic stability, which is difficult to achieve with high unemployment rates - in the working age population (15,9%, 2016), and with an almost 2.20 times higher rate of youth unemployment (45%, 2016.). The paper will present the problem of youth unemployment in Serbia and the phenomenon of brain drain, as well as, some proposals for measuring and soloving the unemployment problems will be given. Also, the authors will present comparative analysis of the (un)employment in Serbia from the beginning of the crisis, and projections of the labor force by year 2020. The authors will point out the 2020 Strategy, in the segment related to the expectations concerning the labor marketalong with the employment rate target and suggestions to reach them, stressing that the adoption of the National Qualifications Framework is a necessity in order to synchronize the labor market of the Republic of Serbia, both internally and with the European Qualifications Framework.

AB  - Državna pomoć nedopuštena je u skladu sa članom 107(1) Ugovora o funkcionisanju Evropske unije. Ipak, od opšte zabrane dodele državne pomoći postoje izuzeci, sadržani u Ugovoru o funkcionisanju EU i aktima sekundarnog zakonodavstva Unije. U radu su analizirane odredbe sadržane u Smernicama EU o državnoj pomoći u sektoru poljoprivrede i šumarstva, kao i u ruralnim područjima za period od 2014-2020. godine, pri čemu je stavljen akcenat na državnu pomoć za ruralni razvoj u Evropskoj uniji, kao i na mogućnosti podsticanja socijalnog preduzetništva u ruralnim područjima. Istraživanje je obuhvatilo i aktuelnu praksu Evropske komisije u ovoj oblasti. Praksa je pokazala da je Evropska komisija mahom odobravala državnu pomoć za ove namene. Socijalno preduzetništvo u funkciji maksimiziranja društvenih vrednosti i državne pomoći najosetljivijim grupama društva može dugoročno postaviti temelje ruralnog razvoja. U Evropskoj uniji je koncept socijalnog preduzetništva u savremenoj formi prisutan od 80-tih godina XX veka, dok je u Republici Srbiji u toku proces širenja ovog oblika preduzetništva. U radu su se autori rukovodili sa dva metoda: pozitivno-pravnim metodom, kao i pravno-logičkim metodom indukcije i dedukcije.
AB  - State aid is inadmissible in accordance with Article 107 (1) of the Treaty on the Functioning of the European Union. However, from the general prohibition of state aid, there are exceptions, contained in the Treaty on the Functioning of the EU and acts of secondary legislation of the Union. The paper analyzes the provisions contained in the EU Guidelines on state aid in the agriculture and forestry for rural areas for the period 2014-2020, with an emphasis on state aid for rural development in the European Union, as well as the possibilities of encouraging social entrepreneurship in rural areas. The study included the current practice of the European Commission in this area. Practice has shown that the European Commission approved state aid for this purpose. Social entrepreneurship in the function of maximizing social values and state aid to the most vulnerable groups of society can lay the foundations of rural development in the long run. In the European Union, the concept of social entrepreneurship is present in the contemporary form since the 1980s, while the process of expanding this form of entrepreneurship is under way in the Republic of Serbia. In this paper the author governed by the two methods: positive legal method, as well as legal and logical method of induction and deduction.

Research has shown that if the conditions contained in the guidelines on state aid for environmental protection and energy for the period 2014-2020 are fulfilled, this form of state aid will be permitted. It has been established that there is no practice of the European Commission in connection with this form of state aid. Recommendation to the Member States is to carry out informal consultations with the Commission prior to decisions on the allocation of state aid for the adequacy of production, in order to avoid any legal disputes in the future. The survey used a normative method and logical methods of induction and deduction.

AB  - Zaštita agroindustrije u uslovima vanredne situacije je od vitalnog značaja za ekonomski i društveni razvoj zemlje. Radi toga je kreiran ovaj rad sa ciljem da oceni stepen otpornosti privrednih subjekata u sektoru agroindustrije u AP Vojvodini, i delimično u Republici Srbiji u uslovima vanredne situacije, kako bi se mogle preduzeti mere za povećanje njihove konkurentnosti. U radu je korišćena metodologija adekvatna u oblasti društvenih nauka: pozitivno-pravni metod, logički metodi indukcije i dedukcije, multidisciplinarni pristup, kao i statistički metod. Istraživanjem je utvrđeno da privredni subjekti u najvećoj meri poseduju planove za spasavanje i postupanje u slučaju požara, ali ne i planove za postupanje u vanrednim situacijama. Takođe nisu planirana posebna finansijska sredstva predviđena za te svrhe. Privrednici nisu upoznati sa postojanjem standarda ISO 22301:2012 koji im može biti izuzetno koristan u rešavanju ovog problema. Stepen otpornosti privrednih subjekata u AP Vojvodini u uslovima vanredne situacije iznosi 64.2%. U budućem periodu neophodno je poboljšati primenu propisa, posebno na polju izrade planova za postupanje u vanrednim situacijama, ali i mogućnosti primene standarda ISO 22301:2012. AB  - Protection of agro-industry in emergency situations is of vital importance for economic and social development of a country. This paper is therefore created with a view of assessing the degree of resilience of economic entities within agro-industrial sector in the Autonomous Province (AP) of Vojvodina and partially in the Republic of Serbia in emergency situations, so that measures to increase their competitiveness could be undertaken. The methods adequate for social sciences were used: positive law method, logical induction and deduction, multidisciplinary approach, as well as statistical method. The research established that the economic entities mainly have their own fire rescue and procedure plans, but not emergency action plans. Special financial assets have not been allocated for that purpose either. Businessmen are not acquainted with the existence of ISO 22301:2012 standard, which may be exceptionally useful in solving this problem. The degree of resilience of economic entities in the AP of Vojvodina in emergency situations is 64.2%. It is necessary in the forthcoming period to improve the implementation of regulations, particularly in the field of emergency action plans, but also the possibilities to implement ISO 22301:2012 standard.

AB  - Uticaj vanrednih situacija na poslovanje privrednih subjekata je tema o kojoj se u Republici Srbiji poklanja vrlo mala pažnja, za razliku od razvijenih evropskih zemalja. Vanredne situacije mogu prouzrokovati ogromne štete privrednim subjektima, ali i značajne štete po životnu sredinu. Samim tim, može doći do narušavanja njihove konkurentske pozicije na tržištu, s obzirom na otežano poslovanje, odnosno nemogućnost obezbeđenja kontinuiteta poslovanja. Oblasti koje kompanije treba da razmotre u ekstremnim vreme nekim događajima obuhvataju njihova tržišta, prostorije, ljude, informacione tehnologije i bezbednost podataka, dobavljače, logistiku i isporuku, proizvole, procese, skladišta i sirovine. Zaštita privrednih aktivnosti Srbije (odnosno AP Vojvodine) u vanrednim situacijama, bez obzira na mnoge inicijative, nije u dovoljnoj meri prepoznata kao interdisciplinaran problem, čije rešenje zahteva pažljivu analizu i primenu adekvatnih mera u praksi. Stoga je neophodno pažljivo analizirati ključne faktore rizika po poslovno okruženje, odnosno istražiti uticaj koji vanredne situacije imaju na konkurentnost privrede. Pregledom literature, u radu, ustanovljeno je da postoji veći broj studija koji sadrže pojedine indikatore povezane sa vanrednim situacijama. Razmotreni su rezultati glavnih studija u svetu koje prema izabranim kriterijumima mere uticaj vanrednih situacija na privredne aktivnosti. Izvučeni su zaključci i rezultati najrelevantnijih istraživanja u okviru ove tematike, na osnovu kojih je moguće dati pre poruke i smernice privrednim subjektima Srbije (odnosno AP Vojvodine) vezano za ponašanje u vanrednim situacijama.
AB  - The impact of emergencies on the business of economic entities is a topic with very little attention in the Republic of Serbia in contrast to developed European countries. Emergency situations can cause enormous damage to businesses, as well as significant damage to the environment. Consequently, it can cause distortion of their competitive position on the market, difficulties on the business, or the inability to ensure business continuity. Areas that companies need to consider in extreme weather events, including their markets, are facilities, people, information technology and data security, suppliers, logistics and delivery, products, processes, warehouses and raw materials. Protection of economic activities of Serbia (and AP Vojvodina) in emergency situations, regardless of the many initiatives, is not sufficiently recognized as an interdisciplinary problem, whose solution requires careful analysis and application of appropriate measures in practice. Therefore, it is necessary to carefully analyze the key risk factors to the business environment, and to explore what kind of impact emergency situations have on the competitiveness of the economy. In a review of literature, in the paper, it was found that there are a number of studies that contain certain indicators related to emergency situations. The results of major studies in the world which, according to selected criteria, measure the impact of emergencies on economic activity are discussed. The conclusions are drawn and the results of the most relevant research in the context of these topics are given. On its basis it is possible to provide recommendations and guidance to enterprises in Serbia (and AP Vojvodina) related to the behavior in emergency situations.

AB  - The allocation of state aid is basically prohibited under Article 107(1) of the Treaty on the Functioning of the European union (hereinafter UFEU), which states that unless otherwise is provided, any aid granted by a Member state or given by states resources in any form which distorts or threatens to distort competition by placing certain companies or production of certain goods in favorable position, is incompatible with internal market, to the extent it affects trade between Member state. There are exceptions from the above mentioned prohibition, provided in the Treaty on the Functioning of the European Union. In terms of agriculture and forestry we should mention provisions of the Article 107 (2) (b) UFEU which provide that state aid, given for the purpose of repairing the damage caused by natural disasters or extraordinary events, shall be compatible with internal market. It is similar with Article 107 (3)(c) UFEU, which provides that Commission may consider that the state aid for improvement of economic development of agricultural, forestry and rural areas, is compatible with internal market, if there are no adverse effects on trading conditions.

Određivanje relevantnog geografskog tržišta u pravu konkurencije EU

AB  - U skladu sa odredbama člana 102 Ugovora o funkcionisanju Evropske unije, zabranjena je zloupotreba dominantnog položaja na unutrašnjem tržištu. Da bi se mogla napraviti adekvatna procena ponašanja preduzeća, mora se definisati relevantno tržište. Relevantno tržište ima dve dimenzije: proizvodnu i geografsku. U ovom radu akcenat je stavljen na određivanje relevantnog geografskog tržišta. Izvršena je analiza pozitivno-pravnih propisa Unije, kao i odgovarajuće prakse Evropske komisije i Suda pravde. Utvrđeno je da je prilikom određivanja relevantnog geografskog tržišta korišćeno više različitih kriterijuma: kriterijum dovoljno homogene oblasti, aktivnosti preduzeća, trgovinske barijere, transportni troškovi, navike potrošača, spoljna konkurencija, barijere za ulazak na tržište, cene, i slično. Autor se, pritom, rukovodio sa dva metoda: pozitivno pravnim metodom za analizu pozitivnih pravila u vezi sa određivanjem geografskog tržišta, kao i pravno-logičkim metodom indukcije i dedukcije.
AB  - In accordance with the provisions of Article 102 of the Treaty on the Functioning of the European Union, the abuse of a dominant position in the internal market is prohibited. In order to make a proper evaluation of the behavior of enterprises, the relevant market must be defined. Relevant market has two dimensions: the production and geographic. In this paper, the emphasis is placed on determining the relevant geographic market. The analysis of positive legal regulations of the Union, as well as the proper practice of the European Commission and the Court of Justice is performed. It was found that in determining the relevant geographic market several different criteria were used: sufficiently homogeneous area, the undertakings' activities, barriers to trade, transportation costs, consumer preferences, outside competition, barriers to entry, prices. The author has, in doing so, led by two methods: positive legal method to analyze the positive rules concerning determination of geographic market, as well as legal and logical method of induction and deduction.

AB  - Ugroženost privrede u vanrednim situacijama predstavlja ozbiljan problem u današnjem svetu. Vanredne situacije izazivaju velike posledice po konkurentnost privrede i ne postoji privredna grana u kojoj one ne izazivaju ozbiljne probleme u funkcionisanju privredne aktivnosti. Jedno od sredstava za otklanjanje štetnih posledica predstavlja adekvatna pravna regulativa. U radu su analizirani propisi Republike Srbije koji se odnose na vanredne situacije, propisi Evropske unije, kao i standard ISO 22301:2012. U istraživanju su korišćeni normativni metod i logički metodi indukcije i dedukcije.
AB  - The vulnerability of the economy in an emergency situation is a serious problem in today's world. Emergency situations cause major consequences for the competitiveness of the economy and there is no branch of the economy in which they do not cause serious problems in the functioning of economic activity. One of the means for eliminating harmful effects are appropriate legal regulations. The paper analyzes the regulations of the Republic of Serbia relating to emergency situations, the regulations of the European Union, as well as the standard ISO 22301:2012. The study uses the normative method and the logical method of induction and deduction.

AB  - Državna pomoć za železnički transport podstiče prelazak na ekološki čistije vidove prevoza putnika i robe. Analiza propisa EU pokazuje da se državna pomoć za železnički transport može dodeliti za finansiranja železničkih preduzeća uz pomoć infrastrukturnog finansiranja, za kupovinu i obnovu voznog parka, otkazivanje dugova od strane država članica u cilju finansijskog reaktiviranja železničkih preduzeća, za restrukturiranje železničkih preduzeća, za potrebe koordinacije transporta, kao i za državne garancije za železnička preduzeća. Ipak, odredbe o državnoj pomoći teško će se sprovesti u delo na teritoriji Republike Srbije, naročito kad je reč o pragovima pomoći postavljenim u Smernicama. Rešenje predstavlja regionalna državna pomoć, jer se Republika Srbija, imajući u vidu stepen privredne razvijenosti može u celini svrstati pod statistički region A. Na taj način, neće doći do kršenja odredaba Unije o državnoj pomoći.
AB  - State aid for railway transport encourages the shift to environmentally cleaner modes of transport of passengers and goods. Analysis of EU regulations show that state aid for railway transport can be assigned to finance railway companies to help finance infrastructure, for the purchase and renewal of rolling stock, the cancellation of debts by the Member States in order to finance the reactivation of railway companies, the restructuring of railway companies for the purpose of coordination of transport, as well as government guarantees for railroad companies. However, the provisions on state aid may be difficult to make it work in the territory of the Republic of Serbia, especially when it comes to the thresholds set out in the Guidelines. The solution is a regional state aid, because the Republic of Serbia, bearing in mind the level of economic development as a whole can be classified under statistical region 'A. In this way there will be no violations of EU state aid provisions.

AB  - Kartelsko ponašanje predstavlja jedan od najopasnijih oblika narušavanja konkurencije na unutrašnjem tržištu Evropske unije, kao i najtežu povredu člana 101. Ugovora o funkcionisanju EU. Uz pomoć kartela, preduzeća izbegavaju pritiske koji podstiču na inovativnost i uvođenje efikasnijih proizvodnih metoda. Takva delovanja izazivaju i druge negativne efekte, kao što su skuplje sirovine i delovi za preduzetnike u Uniji koji kupuju od učesnika kartela, veštačke cene, a takođe smanjuju izbor potrošača. Dugoročno, karteli umanjuju konkurenciju, ali i šanse za zapošljavanje. Imajući u vidu veliku ekonomsku krizu, kažnjavanje kartelskog ponašanja još više dobija na značaju. U radu se razmatraju uslovi pod kojima Evropska komisija može izreći kazne za kršenje člana 102. Ugovora o funkcionisanju EU, kao i relevantna praksa u ovoj oblasti. U istraživanju su korišćeni normativni metod i logički metodi indukcije i dedukcije.
AB  - Cartel behavior is one of the most dangerous forms of competition distortion within the internal market of the European Union, as well as the most serious breach of Article 101 of the Treaty on the Functioning of the EU. With the help of a cartel, firms avoid the pressures that encourage innovation and introduction of more efficient production methods. Such actions cause other negative effects, e.g. more expensive raw materials and parts for the EU entrepreneurs who buy from the cartel participants, artificial prices, and reduce consumer choice. In the long term, cartels reduce competition and employment opportunities. Bearing in mind the great economic crisis, punishing cartel behavior is even more important. This paper discusses the conditions under which the European Commission can impose penalties for violation of Article 102 of the Treaty on the Functioning of the EU, as well as the relevant practice in this area. The study used a normative method and logical methods of induction and deduction.

AB  - Zloupotreba dominantnog položaja zabranjena je čl. 102. Ugovora o funkcionisanju EU. Jedan od oblika zloupotrebe dominantnog položaja predstavljaju ugovori o ekskluzivnoj trgovini. Praksa je pokazala da preduzeće koje je u dominantnom položaju na tržištu i veže kupce, uz pomoć obaveze ili obećanja sa njihove strane, da će pribavljati sve ili najveći deo svojih potrepština isključivo od datog preduzeća, vrši zloupotrebu dominantnog položaja. Ipak, ovi ugovori nisu nedopušteni per se. Argument protiv automatske zabrane ugovora o ekskluzivnom poslovanju leži u činjenici da ovi ugovori mogu biti objektivno opravdani s obzirom na njihove efekte na tržištu u svakom pojedinačnom slučaju. Objektivno opravdanje bi moglo biti moguće u situacijama u kojima bi antikonkurentski efekti datog ugovora o ekskluzivnom snabdevanju bili svedeni na minimum nužan za postizanje određenih ekonomskih prednosti, kao što su sigurnost snabdevanja, niže cene i druge pogodnosti. Iskustva Evropske komisije biće od velike kori- sti za Komisiju za zaštitu konkurencije Republike Srbije, s obzirom na nedostatak odgovarajuće prakse u ovoj oblasti.
AB  - Abuse of a dominant position is prohibited by Article 102 of the Treaty on the Functioning of the EU. One form of abuse of dominant position is the exclusive dealing contracts. Practice has shown that an undertaking which is in a dominant position on the market, and ties purchasers by an obligation or promise on their part to obtain all or most of its supplies exclusively from the said company, abuses its dominant position. However, these contracts are not inadmissible per se. The argument against the automatic ban on exclusive contracts business lies in the fact that these contracts can be objectively justified in view of their effects on the market in each case. Objective justification might be possible in situations where the anti-competitive effects of the exclusive dealing contracts were reduced to the minimum necessary to achieve certain economic advantages, such as security of supply, lower prices, and other advantages. Experience of the European Commission will be of great benefit to the Commission for protection of competition of the Republic of Serbia, due to the lack of proper practice in this area.

AB  - Evropa je sa stanovišta učešća u turističkom prometu i potrošnji već decenijama najznačajnije turističko područje sveta. U granicama Evropske unije nalaze se najrazvijenije inicijativne i receptivne turističke zemlje. Dugi niz godina na području Evropske unije velika pažnja se posvećuje razvoju turizma odnosno razvoju pojedinih instrumenata i mera koje treba da omoguće skladan i kontinuiran razvoj turizma. Putem specijalizovanih institucija i fondova Evropska unija pomaže i direktno i indirektno učestvuje kroz razne forme u razvoju turizma i u ruralnim područjima, a jačanje politike ruralnog razvoja postao je jedan od najvećih prioriteta Evropske unije. Uzimajući u obzir značaj finansijske podrške Evropske unije u razvoju turizma, u ovom radu se daje kratak pregled sistema podrške Evropske unije u stimulisanju razvoja turizma, kao i fondova sa posebnim osvrtom na mogućnosti u razvoju seoskog turizma. .
AB  - From the view of participation in touristic market and expenditure, Europe has been the one of the most important touristic areas of the World for decades. Within the borders of European Union the most developed initial and receptive touristic countries are located. During the years, at European Union area, great concern has been dedicated to tourism development, apropos to special instruments and measures development which has to make possible harmonous and continuous tourism development, as well. Through special institutions and funds, European Union supports and directly and indirectly participates by different forms in touristic development in rural areas as well, and rural development policy has become one of the greatest European Union priority. Taking into consideration the importance of European Union financial support in tourism development, this work presents a short oversight of European Union supporting system related to tourism development stimulation, as well as funds with a special consideration to rural tourism development. .

abstract = "Evropa je sa stanovišta učešća u turističkom prometu i potrošnji već decenijama najznačajnije turističko područje sveta. U granicama Evropske unije nalaze se najrazvijenije inicijativne i receptivne turističke zemlje. Dugi niz godina na području Evropske unije velika pažnja se posvećuje razvoju turizma odnosno razvoju pojedinih instrumenata i mera koje treba da omoguće skladan i kontinuiran razvoj turizma. Putem specijalizovanih institucija i fondova Evropska unija pomaže i direktno i indirektno učestvuje kroz razne forme u razvoju turizma i u ruralnim područjima, a jačanje politike ruralnog razvoja postao je jedan od najvećih prioriteta Evropske unije. Uzimajući u obzir značaj finansijske podrške Evropske unije u razvoju turizma, u ovom radu se daje kratak pregled sistema podrške Evropske unije u stimulisanju razvoja turizma, kao i fondova sa posebnim osvrtom na mogućnosti u razvoju seoskog turizma. ., From the view of participation in touristic market and expenditure, Europe has been the one of the most important touristic areas of the World for decades. Within the borders of European Union the most developed initial and receptive touristic countries are located. During the years, at European Union area, great concern has been dedicated to tourism development, apropos to special instruments and measures development which has to make possible harmonous and continuous tourism development, as well. Through special institutions and funds, European Union supports and directly and indirectly participates by different forms in touristic development in rural areas as well, and rural development policy has become one of the greatest European Union priority. Taking into consideration the importance of European Union financial support in tourism development, this work presents a short oversight of European Union supporting system related to tourism development stimulation, as well as funds with a special consideration to rural tourism development. .",

U radu su analizirane odredbe ovog akta, što ima za cilj da se ukaže na nova rešenja u odnosu na prethodne smernice iz 2009. U analizi je korišćeno nekoliko metoda tumačenja prava: jezičko, logičko i ciljno tumačenje. Analizom je utvrđeno da, u odnosu na prethodne smernice, pomenuti akt promoviše princip tehnološke neutralnosti, otvoreni pristup širokopojasnoj mreži, transparentnost, kao i obavezu da nova infrastruktura širokopojasnih mreža predstavlja značajno, a ne marginalno unapređenje u odnosu na postojeću mrežu. Praksa Komisije biće od velike koristi telima za kontrolu državne pomoći u Republici Srbiji, naročito u procesu priključenja EU.
AB  - The European Commission has drawn up a proposal of new Guidelines on the application of State aid rules in relation to the rapid development of broadband networks. This paper analyzes the provisions of this act, which aims to draw attention to new solutions compared to the previous guidelines from 2009. This study used several methods of interpretation: linguistic, logical and goal interpretation. The analysis showed that, compared to previous guidance, the Act itself promotes the principle of technological neutrality, open access broadband network, transparency, and commitment to a new broadband infrastructure is a significant, not marginal, improvement over the existing network. The practice of the Commission will be useful for the bodies for control of state aid to the Republic of Serbia, especially in the EU accession process.

AB  - Veliki broj preduzeća u EU je investirao značajna finansijska sredstva u proizvodnju, kao i u dugoročne ugovore o kupovini, odnosno isporuci električne energije. Međutim, liberalizacija elektroenergetskog tržišta Evropske unije dovela je do pada cena električne energije za potrošače, ali i stavila proizvođače u nepovoljan konkurentski položaj. Stoga, pomenutim subjektima je bila neophodna državna pomoć. Iako u EU postoji generalna zabrana državne pomoći, od tog pravila postoje izuzeci. U radu je izvršena teorijska i praktična analiza uslova pod kojima je dozvoljena dodela državne pomoći, u cilju kompenzacije za dugoročne investicije ili obaveze preduzete od strane elektro-energetskih preduzeća, u periodu pre liberalizacije tržišta. Autori su se, pritom, rukovodili sa dva metoda: pozitivno pravnim metodom za ozbiljniju analizu pozitivnih pravila u vezi sa državnom pomoći, kao i pravno-logičkim metodom indukcije i dedukcije.
AB  - A large number of companies in the EU have invested significant funds into production, and into long-term contracts for the purchase or delivery of electricity. However, the liberalization of the electricity market of the European Union has led to a fall in electricity prices for consumers, but also producers put in an unfavourable competitive position. Therefore, the above mentioned subjects needed public support. Although the EU there is a general ban on State aid to this rule there are exceptions. The Article presents a theoretical and practical analysis of the conditions under which the allocation of state aid to compensate for long-term investments or commitments, undertaken by the electricity companies in the pre-liberalization, was permitted. The authors have, in doing so, led by two methods: positive legal method to analyze the positive rules concerning state aid, as well as legal and logical method of induction and deduction.

AB  - Reindustrijalizacija privrede iziskuje preduzimanje velikog broja pravno-ekonomskih mera, uključujući i mere iz oblasti prava konkurencije. To podrazumeva borbu protiv mnogobrojnih oblika narušavanja konkurencije, posebno zloupotrebe dominantnog položaja. U radu je razmotren jedan od najznačajnijih oblika zloupotrebe dominacije - odbijanje isporuke. Pritom, izvršena je pravna analiza praktičnog postupanja institucija Unije u vezi sa odbijanjem isporuke, kako bi se pružile smernice za postupanje srpskoj Komisiji za zaštitu konkurencije. Utvrđeno je da Komisija i Sud pravde EU imaju izrazito negativan stav u pogledu odbijanja isporuke od strane dominantnog učesnika na tržištu. Prilikom procene da li je u datom slučaju došlo do kršenja pravila o slobodnoj konkurenciji, poseban izazov za Komisiju predstavljaće doktrina o neophodnim resursima, kao i dilema da li će sopstvenici tog neophodnog resursa uvek morati da omoguće pristup njegovim kapacitetima svakome ko to zatraži. Utvrđeno je da će odbijanje pristupa resursu biti dopušteno, ukoliko postoji objektivno opravdanje za takav potez. Ipak, ostaje nedoumica da li će Komisija i Sud uvek biti u stanju da nepogrešivo procene da li je neki resurs zaista neophodan konkurentima, kao i da li odbijanje pristupa predstavlja legitiman poslovni potez dominantnog učesnika. U radu su korišćeni pozitivno-pravni metod i pravno-logički metodi indukcije i dedukcije.
AB  - Re-industrialisation of the economy requires undertaking a large number of legal and economic measures, including measures in the field of competition law. It means fighting against many forms of distortion of competition, especially abuse of dominant position. This Article reviews one of the most important forms of abuse of dominance-refusal of supply. In doing so, a legal analysis of the practical actions of the Union institutions in connection with the refusal of supply are conducted, in order to provide guidance to Serbian Commission for Protection of Competition in resolving cases in practice. It was found that the Commission and the EU Court of Justice have extremely negative attitude in connection with the refusal of supply by the dominant undertakings. In assessing whether the rules of free competition are violated in a given case, a challenge for the Commission will be a doctrine of the essential facilities, and the problem of whether the owners will always have to provide access to its facilities to anyone who requests it. It was found that the refusal of access to the resource be allowed, unless there is objective justification for such a move. However, there is confusion as to whether the Commission and the Court will always be able to unfailingly evaluate whether a resources are truly indispensable for competitors, and whether the denial of access is a legitimate business move of dominant participants. In this Article, positive legal method and legal and logical method of induction and deduction are used.

AB  - S obzirom na sve veći stepen nekonkurentnosti rudnika uglja u EU, pojavio se problem kako snositi troškove njihovog zatvaranja. Posledice zatvaranja rudnika mogu biti ekonomske, socijalne, kao i ekološke, što prouzrokuje brojne troškove. Za to su potrebna velika finansijska sredstva, pa države članice pribegavaju dodeli državne pomoći za ove namene. S obzirom da je državna pomoć nedopuštena, Savet je doneo Odluku o državnoj pomoći radi omogućavanja zatvaranja nekonkurentnih rudnika uglja. Odlukom su regulisana dva oblika državne pomoći: a) pomoć za zatvaranje proizvodnih jedinica koje posluju sa gubicima i b) pomoć za pokrivanje vanrednih troškova. Takođe, Savet je postavio i uslove koje je neophodno ispuniti kako bi državna pomoć bila kompatibilna sa unutrašnjim tržištem. Od 2011. godine bilo je svega par slučajeva pred Komisijom, gde je doneta odluka o kompatibilnosti. Praksa Komisije biće od značaja za Republiku Srbiju, imajući u vidu razvijenu rudarsku delatnost, kao i negativne posledice koje će proisteći iz zatvaranja rudnika.
AB  - Given the increasing level of uncompetitive coal mines in the EU, the problem appeared how to bear the cost of their detention. The consequences of the closure of the mine may be economic, social, and environmental, which cause numerous costs. This requires significant financial resources, and member states resort to grant state aid for this purpose. Since state aid is not permitted, the Council adopted a Decision on State aid to facilitate the closure of uncompetitive coal mines. The decision regulates the two forms of government assistance: a) support for the closure of production units that operate with losses and b) aid to cover the exceptional costs. Also, the Council set the conditions to be fulfilled in order to state aid was compatible with the internal market. Since 2011, there were only a few cases before the Commission, where the decision on compatibility was taken. The practice of the Commission will be of importance for the Republic of Serbia, bearing in mind the developed mining activity, and the negative consequences that will result from the closure of the mines.

Praksa Komisije biće od značaja za Republiku Srbiju, imajući u vidu razvijenu rudarsku delatnost, kao i negativne posledice koje će proisteći iz zatvaranja rudnika., Given the increasing level of uncompetitive coal mines in the EU, the problem appeared how to bear the cost of their detention. The consequences of the closure of the mine may be economic, social, and environmental, which cause numerous costs. This requires significant financial resources, and member states resort to grant state aid for this purpose. Since state aid is not permitted, the Council adopted a Decision on State aid to facilitate the closure of uncompetitive coal mines. The decision regulates the two forms of government assistance: a) support for the closure of production units that operate with losses and b) aid to cover the exceptional costs. Also, the Council set the conditions to be fulfilled in order to state aid was compatible with the internal market. Since 2011, there were only a few cases before the Commission, where the decision on compatibility was taken. The practice of the Commission will be of importance for the Republic of Serbia, bearing in mind the developed mining activity, and the negative consequences that will result from the closure of the mines.",

AB  - U radu su analizirani pravno-ekonomski aspekti izveštavanja o ekološkim aspektima poslovanja preduzeća kao dela izveštavanja o održivom razvoju. Zahtevi za zaštitom životne sredine postali su značajan faktor koji preduzeća moraju uzeti u obzir u procesu donošenja poslovno-finansijskih odluka. Imajući to u vidu, izveštavanje o ekološkim aspektima poslovanja postaje sve značajniji deo dobrovoljnog izveštavanja od strane preduzeća. Sama implementacija izveštavanja o ekološkim aspektima poslovanja preduzeća podrazumeva jačanje odgovornosti preduzeća za objašnjenje informacija o ekološkim performansama poslovanja i zadovoljenje zahteva u vezi obelodanjivanja takvih informacija. Usled sve većih potreba stejkholdera preduzeća za informacijama o uticaju poslovnih aktivnosti preduzeća na životnu sredinu i njen kvalitet, brojne međunarodne organizacije i institucije nastojale su da zajedničkim snagama ustanove adekvatnu normativnu regulativu u ovoj oblasti. S tim u vezi, najpre se polazi od pravnih aspekata izveštavanja, gde je akcenat stavljen na Arhusku konvenciju. Potom su analizirane smernice, razvijene od strane Globalne inicijative za izveštavanje (Global Reporting Initiative - GRI), kao najsveobuhvatnije i najzastupljenije uputstvo za izveštavanje o održivom razvoju, odnosno za izveštavanje o ekonomskim, ekološkim i društvenim aspektima poslovanja preduzeća.
AB  - In this paper we analysed legal-economic aspects of reporting on environmental aspects of companies' business operations as a part of sustainability reporting. Environmental protection requirements have become a significant factor that companies have to consider in the business-financial decisions making process. Bearing that in mind, reporting on environmental aspects of companies' business operations is becoming an increasingly important part of the companies' voluntary reporting. The implementation of reporting on environmental aspects of companies' business operations by itself includes strengthening companies' accountability for explaining the environmental performance information and meeting the requirements on disclosure of such information. Due to the growing needs of companies' stakeholders for information about the companies' business operations impact on the environment and its quality many international organisations and institutions have endeavored to jointly establish adequate normative regulations in this area. Regarding that, we firstly consider legal aspects of reporting where the emphasis was placed on the Aarhus Convention. Then, we analyse guidelines developed by the Global Reporting Initiative (GRI) as the most comprehensive and the most common guidance for sustainability reporting i.e. for reporting on economic, environmental and social aspects of companies' business operations.

AB  - Odgovornost za štetu u životnoj sredini predstavlja realizaciju principa "zagađivač plaća", koji je prihvaćen i u Evropskoj uniji. To pitanje je regulisano Direktivom o odgovornosti za životnu sredinu u pogledu sprečavanja i otklanjanja štete u životnoj sredini. U analizi su korišćeni jezičko i logičko tumačenje. Direktiva propisuje strogi režim odgovornosti za operatere i zasnovana je na ovlašćenjima i dužnostima javne vlasti. Ona ne omogućava privatnim licima pravo na naknadu štete u životnoj sredini ili preteće opasnosti od štete. To znači da se ne primenjuje na štete po imovinu, ekonomske štete ili povrede. Direktiva nije do kraja uredila pitanje odgovornosti za štetu u morskoj sredini, pojedini pravni standardi su nedovoljno razjašnjeni. Takođe, tržište osiguranja od odgovornosti za štetu u životnoj sredini je u začetku. Osim toga, potrebno je podići svest operatera i poslovnog sektora o postojanju Direktive i obavezama koje iz nje proističu i ujednačiti praksu između država članica u pogledu oslobađanja od odgovornosti za pričinjenu štetu, sa pozivanjem na permit defence" ili "state of the art defence". Na kraju, Direktivom nije rešeno pitanje nadoknade štete u životnoj sredini koja je velikih razmera.
AB  - Liability for damage to the environment is the implementation of the "polluter pays" principle, which is also accepted in the European Union. This is regulated by the Directive on environmental liability with regard to the prevention and elimination of environmental damage. In this Article we were used several forms of interpretation: linguistic and logical interpretation. The Directive provides for strict liability regime for operators and is based on the powers and duties of public authorities. It does not allow private citizens the right to compensation for environmental damage or imminent threat of damage. It means that Directive do not apply to property damage, economic damage or injury. Directive has not been fully resolve issue of liability for damage to the marine environment, certain legal standards are not completely understood. Also, market of insurance for liability for damage to the environment is a stub. In addition, it is necessary to raise awareness of business operators about the existence of the Directive and the obligations arising from it, and standardize practices between Member States as regards the exemption from liability for damages, with reference to the "permit defense" or "state of the art defense". Finally, the Directive has not resolved the issue of large-scale damages to the environment.
