State aid for investments in power generation in response to the liberalisation of the EU electricity market
Abstract
A large number of companies in the EU have invested significant funds into production, and into long-term contracts for the purchase or delivery of electricity. However, the liberalization of the electricity market of the European Union has led to a fall in electricity prices for consumers, but also producers put in an unfavourable competitive position. Therefore, the above mentioned subjects needed public support. Although the EU there is a general ban on State aid to this rule there are exceptions. The Article presents a theoretical and practical analysis of the conditions under which the allocation of state aid to compensate for long-term investments or commitments, undertaken by the electricity companies in the pre-liberalization, was permitted. The authors have, in doing so, led by two methods: positive legal method to analyze the positive rules concerning state aid, as well as legal and logical method of induction and deduction.
